DMCA Policy

Neve Umbria respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.

This policy outlines the information required to submit a DMCA notice and counter-notice to Neve Umbria. By operating our service, we strive to protect the rights of copyright holders and provide a clear process for resolving copyright disputes.

Filing a Copyright Infringement Notice (DMCA Takedown Notice)

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Neve Umbria service, you may notify our designated Copyright Agent, as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. Identification of the copyrighted work that you claim has been infringed, including a description of the copyrighted work and, where possible, a copy or the location (e.g., URL) of an authorized version of the work.
  3. Identification of the material that is claimed to be infringing and where it is located on the Neve Umbria service. This information must be specific enough to allow Neve Umbria to locate the material (e.g., a URL to the specific page or content).
  4. Your full name, address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a Counter-Notification

If you believe that your content, which was removed or disabled, is not infringing or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located, or if your address is outside of the United States, for any judicial district in which Neve Umbria may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
